Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Superday ("we," "us" or "our"), concerning your access to and use of the Superday mobile application (the "App").

2. Intellectual Property Rights

Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

3. User Representations

By using the App, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.
2. You have the legal capacity and you agree to comply with these Terms of Service.
3. You are not a minor in the jurisdiction in which you reside (or have parental permission).
4. You will not access the App through automated or non-human means, whether through a bot, script or otherwise.
5. You will not use the App for any illegal or unauthorized purpose.

4. Virtual Currency and Items

The App may include virtual currency ("Coins", "Credits") or virtual digital items ("XP", "Streaks").

• No Real World Value: Virtual items have no real-world monetary value and cannot be redeemed for real money, goods, or other items of value.
• Non-Transferable: Virtual items are non-transferable and may not be sold, traded, or transferred to any other user or third party.
• Revocable License: Your right to use any virtual items is a limited, non-exclusive, non-transferable, revocable license. We reserve the right to manage, regulate, control, modify, or eliminate virtual items at any time.

5. In-App Purchases and Subscriptions

If you purchase a subscription or make an in-app purchase:

• Payment: Payment will be charged to your Apple Media Account or Google Play Account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.

6. Prohibited Activities

You may not access or use the App for any purpose other than that for which we make the App available. Prohibited activity includes:

• Systematically retrieving data or other content from the App to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Trick, defraud, or mislead us or other users.
• Interfere with, disrupt, or create an undue burden on the App or the networks or services connected to the App.
• Use the App in a manner inconsistent with any applicable laws or regulations.

7. Disclaimer

THE APP IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE APP AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APP AND YOUR USE THEREOF.

8. Platform Terms (Apple & Google)

The following terms apply if you are accessing the App via an application obtained from the Apple App Store or Google Play Store. You acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. or Google Inc., and they are not responsible for the App or the content thereof.
